We are committed to keeping your personal information private. Please review our Juxtapus mobile and desktop application (“Application”) and www.Juxtapus.com website’s (“Site”) Privacy Policy, Terms of Service, and any other rules or policies posted to the Site and Application which also govern your download, use and license of the Application and any associated online and mobile services (together “Services”).

This Privacy Policy covers the collection, use, and disclosure of personal information that may be collected by us anytime you interact with Site, Application and Services. Please read this Privacy Policy carefully so that you are aware of your legal rights and obligations with respect to the Application or Juxtapus Pty Ltd. and any of its affiliates, parents and subsidiaries (individually and collectively, "we," "us," “our” or "JUX").

  • ACCESS TO THE SITE, APPLICATION AND SERVICES IS VOID AND UNAUTHORIZED WHERE PROHIBITED BY APPLICABLE LAW OR REGULATION.
  • BY USING THE SITE, APPLICATION OR SERVICES, YOU (I) SIGNIFY YOUR IRREVOCABLE ACCEPTANCE OF THIS PRIVACY POLICY; AND (II) REPRESENT THAT YOU ARE AT LEAST 18 YEARS OF AGE, AN EMANCIPATED MINOR, OR POSSESS LEGAL PARENTAL OR GUARDIAN CONSENT, AND ARE FULLY ABLE AND COMPETENT TO ENTER INTO THE TERMS, CONDITIONS, OBLIGATIONS, AFFIRMATIONS, REPRESENTATIONS AND WARRANTIES SET FORTH IN THIS PRIVACY POLICY.
  • FURTHER, IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, OR ANY OF ITS TERMS, PLEASE DO NOT PROVIDE US WITH YOUR PERSONALLY IDENTIFIABLE INFORMATION (“PII”) FOR EXAMPLE YOUR FULL NAME, EMAIL ADDRESS, MAILING ADDRESS, TELEPHONE NUMBER, OR CREDIT CARD NUMBER OR ANY OTHER PERSONAL INFORMATION CAPABLE OF BEING ASSOCIATED WITH YOU INDIVIDUALLY THROUGH ONE OR MORE IDENTIFIERS.
  • OUR BUSINESS CHANGES CONSTANTLY. YOU SHOULD CHECK THE SITE, APPLICATION AND THE SERVICES FREQUENTLY TO SEE IF THERE ARE RECENT CHANGES TO THIS PRIVACY POLICY.
  • JUX RESERVES THE RIGHT TO REVISE THIS PRIVACY POLICY AT ANY TIME. YOUR CONTINUED USE OF THE SITE, APPLICATION AND SERVICES SHALL BE DEEMED AN IRREVOCABLE ACCEPTANCE OF ANY SUCH REVISIONS.
  1. Description. The Application and the associated Services, as described below, enable you, the user (“User”) to create, compose, share, perform, produce and sell/license original musical pieces by combining user generated notes with the Application’s artificial intelligence.
  2. Definitions
    • “Services” refer to the server-based functionality that interoperates with the Application.
    • Users may, where and if available, submit data, text, images, sounds, music, videos, files and any other information or materials to the Site, Application or Services (together, “Submission”).
  3. What information do the Site and Application collect?
    1. Activity by Registered Users. Our Site and Application may provide you with the ability to register an account Site (“Account”).
      1. Personally Identifiable Information. We collect Personally Identifiable Information ("PII") when you use our Application and our Services.
      2. We may ask for and collect some PII when you create an Account, including, but not limited to your name, e-mail address, address, phone number and date of birth. We may also collect additional demographic information. Once you register an Account, we also collect a variety of information and PII depending on the Services you use or engage in such as what Submissions you make.
      3. Content Uploaded to the Site/Application. Any PII or Submissions that you voluntarily disclose online and through our Application may become publicly available and can be collected, viewed and used by third parties.
      4. Two Factor Authentication. We may in the future enable two factor authentication as part of which we will ask Users for their mobile phone number.
    2. Activity by Non-Registered Users. Non-registered Users of the Site (“Visitors”) may choose to browse, search and examine content and information on the Site without registering with the Site. Visitors may also use a feature-limited version of our online Application and its related Services. When you visit our Site as a Visitor and use our Application without registration, we collect only information you provide or submit to us directly, information you send to us by email, information and messages you send or post through our accounts on third party social networks (such as Facebook, YouTube or Twitter) or information or messages you send through any phone, SMS or mobile services we may provide.. The foregoing statement notwithstanding, our servers may recognize and collect Visitors’ domain names, IP addresses and any information on pages you visit.
    3. Usage Information. We may collect information about your usage, such as when you use the Site, the Submissions you make, purchases you make, the frequency and size of data transfers, as well as information you display or click on. If you are logged into your Account, we may associate this information with your Account.
    4. Surveys & Newsletters. We may now or in the future send or run surveys or provide newsletters to our Users. At such time we may request certain identifying information such as name and email address.
    5. Click-Through URLs. In some of our email we may use a “click-through URL” linked to content on the Site. When Users click one of these URLs, they pass through our web server before arriving at the destination page. We may track this click-through data to help us determine interest in particular topics and measure the effectiveness of our communications.
  4. How do we use the information you provide us? JUX uses information for the following general purposes:
    1. We may use your PII to enable Application features including the sharing and licensing of your Submissions.
    2. Subject to the above provisions, your registered username may be displayed to other Users when you provide Submissions.
    3. We may use any of the information under our control in order to improve, or to better understand how our services are used.
    4. We do not collect any credit card information directly. All such financial information is collected and processed by a third-party processor. The financial information collected is used to bill you for purchased Services. If you used a credit card to pay for any purchase on the Site/Application, your credit card account information may be subject to verification by the issuing credit card company or other third-party company. Unless you give us permission at the time such information is collected, this information will not be used for any purpose except for the fulfillment and record keeping of the transaction.
    5. We may use your PII to contact you in order to answer a question or address a concern that you've raised, or to provide customer service on your Account.
    6. We may use your PII to conduct research by sending you a survey.
    7. We reserve the right to send you certain communications relating to your Account, such as service announcements and administrative messages.
    8. We may use your PII to send you marketing and promotional emails. You may opt-out of receiving commercial emails from us at any time by using the unsubscribe links provided in our emails.
    9. We may share information collected including your PII with our agents, representatives, contractors, service providers so they can provide us with support services such as e-mail origination, support services and customer relationship management services.
    10. We use both your PII and certain non-PII (such as anonymous user data, IP addresses, browser type, click stream data, etc.) to improve the quality and design of the Site, Application and Services and to create new features, promotions, functionality and services by storing, tracking, analyzing and processing User preferences and trends, as well as User activity and communications.
    11. Your PII may be passed on to a third party in the event of a transfer of ownership or assets of JUX or a bankruptcy. We may also disclose PII or financial information when we determine that such disclosure is necessary to comply with applicable law, to cooperate with law enforcement or to protect the interests or safety of JUX or other Users of the Site, Application or Services. Whenever PII is disclosed under this paragraph, we may also disclose your demographic information on a non-anonymous basis.
  5. How does JUX Protect Users Personal Information? We implement a variety of security measures to ensure the security of your PII on our systems. All purchases are completed using Stripe, our third-party credit card processor.
    1. When making or receiving any payment through our Application, Site and Services, you agree to the Stripe Connected Account Agreement.
    2. Please be aware that emails or other messages you send to us are not necessarily secure against interception and you should not include sensitive information in those messages. We generally will not ask for your password or other sensitive information in an email and you should assume that if you get such a request, it might be fraudulent.
      • Except as provided above, the Site is not encrypted.
      • Access to your Account profile is restricted by your password.
      • We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.
      • No method of transmission over the Internet, or method of electronic storage, is 100% secure, therefore, while we strive to use commercially acceptable means to protect your PII, we cannot guarantee its absolute security.
      • Third parties may unlawfully attempt to intercept or access transmissions or private communications. Although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications would always remain private.
  6. Individuals under 13 years of age. Pursuant to the provisions of the 1998 Federal Children’s Online Privacy Protection Act (“COPPA”), our policy is to refuse individuals under 13 years of age access to the Site, Application and Services. We therefore do not knowingly collect personal information from individuals under 13 years of age.
  7. Does JUX Use Cookies? We use "cookies" (small pieces of data we store for an extended period of time on your computer, mobile phone, or other device) provided though our analytics services to analyze the Site/Application performance and improve our Services.
  8. How do you change PII provided or OPT-OUT? JUX may in the future enable capabilities providing its registered Users with an option for modifying or removing some of the information that it has about them from its database. This limited option may be accomplished by altering information Submitted to your profile or Account. Please note that we require some PII in order to provide you with access to our Services. If you wish to delete certain PII required for Account maintenance such as your name or e-mail address, you may be required to terminate your Account. However, please note, that while such a tool may be provided now or in the future, you acknowledge that we may retain archived or cached copies of your PII. The above not withstanding, please note that not all PII monitored, stored, tracked or submitted to us shall be controllable by Users and may not be removed from the Application or our Services.
  9. How Long Do We Keep your Information? Except as otherwise provided, User’s PII is maintained by us for as long as it is needed to provide you with access to our Site, Application and Services.
  10. Do-Not-Track. The Site does not currently respond to browser “do not track” signals or other similar mechanisms.
  11. California Privacy Rights. California Civil Code Section 1798.83 allows users who are California residents to request certain information about the disclosure of their information to third parties for direct marketing purposes. To make such a request, please contact as provided below.
  12. By visiting or using the Site, Application or Services, you consent to the collection and use of information by us as set forth in this Privacy Policy. If we decide to change our Privacy Policy, we will post those changes within this page so Users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Be sure to review our Privacy Policy, Terms of Services and any rules regularly so that you will be aware of any changes to them. Please remember that your continued use of this Site, Application or Services, and/or maintenance of an Account after changes or revisions have been made constitute your acceptance of such updates.
